UNDER AGE DRIVING IN ATLANTA
The state of Atlanta abhors an underage driving under the influence of substance. The law does not have leniency for a youth under 21 years operating a vehicle with alcohol or any other substance in his system. It is an offence that is not pardonable in Georgia. A teen within the ages of 16 to 21 years will be penalized as follows:
- First DUI Offense
- Suspension of his driving licence for 6 months (if his BAC is under 0.08%) or suspension for 12 months (if his BAC is 0.08% or higher). Note, this is with or without an administrative license suspension.
- $210 fee.
- He will pay and attend a DUI Alcohol or Drug Risk Reduction Program.
Note, if he ends up with an administrative license suspension, he will be able to get a limited driving permit. Note also, the permit will be cancelled if he is found guilty.
- Second DUI Offense
Regardless of BAC, penalties for a second offense within 5 years are:
- License suspension for 18 months.
- $310 fee.
- He will pay and attend a DUI Alcohol or Drug Risk Reduction Program.
- He will undergo a clinical evaluation and possible treatment.
- Ignition interlock device and permit with court permission (usually after 120 days).
- Third DUI Offense
Penalties for a third offense within 5 years are:
- License suspension for 5 years.
- $410 fee.
- He will pay and attend a DUI Alcohol or Drug Risk Reduction Program.
- He will undergo a clinical evaluation and possible treatment.
- Ignitions interlock device and habitual violator probationary license with court permission (usually after 2 years).
