Is It Possible To Win A DUI Case?

This feeling of hopelessness is exactly what the prosecution counts on. They want you to plead guilty at your first court appearance to save them the work of proving their case. But an arrest is not a conviction. DUI cases are won every single day in Atlanta courtrooms—often in cases that looked “impossible” at first glance.
Most people think winning means a “Not Guilty” verdict from a jury. While that is the ultimate victory, “winning” in DUI defense actually has three tiers. Any of these outcomes is vastly superior to a DUI conviction.
Total Dismissal
The charges are completely dropped. This usually happens when we prove the initial stop was illegal or evidence was destroyed.

Acquittal
Taking the case to trial and having a judge or jury find you "Not Guilty" based on lack of evidence.
DUI law is highly technical. It relies on science (blood/breath tests) and procedure (police protocol). If the state fails in either area, the case crumbles.
