Is It Possible To Win A DUI Case?

But an arrest is not a conviction. DUI cases are won every single day in Atlanta courtrooms—often in cases that looked “impossible” at first glance.

What Does “Winning” Look Like?

Most people think winning means a “Not Guilty” verdict from a jury. While that is the ultimate victory, “winning” in DUI defense actually has three tiers. Any of these outcomes is vastly superior to a DUI conviction.

 

Total Dismissal

The charges are completely dropped. This usually happens when we prove the initial stop was illegal or evidence was destroyed.

Total Dismissal

Getting the charge reduced to Reckless Driving. This saves your license, avoids the DUI stigma, and often prevents jail time.

Acquittal

Taking the case to trial and having a judge or jury find you "Not Guilty" based on lack of evidence.

How Do We Win?

DUI law is highly technical. It relies on science (blood/breath tests) and procedure (police protocol). If the state fails in either area, the case crumbles.

 

  •  The Stop Was Bad: If the officer didn’t have a valid reason to pull you over (e.g., you stayed in your lane), everything after the stop is inadmissible.
  •  The Machine Was Wrong: The Intoxilyzer 9000 must be calibrated and maintained perfectly. We check the logs. If it skipped a check, the results are out.
  •  Medical Issues: Acid reflux, diabetes, or even dental work can trap “mouth alcohol” and cause false high readings.
