Note, if he ends up with an administrative license suspension, he will be able to get a limited driving permit. Note also, the permit will be cancelled if he is found guilty.

  1. Second DUI Offense

Regardless of BAC, penalties for a second offense within 5 years are:

  • License suspension for 18 months.
  • $310 fee.
  • He will pay and attend a DUI Alcohol or Drug Risk Reduction Program.
  • He will undergo a clinical evaluation and possible treatment.
  • Ignition interlock device and permit with court permission (usually after 120 days).
    • Third DUI Offense

Penalties for a third offense within 5 years are:

  • License suspension for 5 years.
  • $410 fee.
  • He will pay and attend a DUI Alcohol or Drug Risk Reduction Program.
  • He will undergo a clinical evaluation and possible treatment.
  • Ignitions interlock device and habitual violator probationary license with court permission (usually after 2 years).
